Definitions & Interpretation
In these Terms and Conditions of Sale:
- “Company” refers to AJS Sawmill Ltd.
- “Customer” refers to the purchaser of goods from the Company.
- “Conditions” refers to these Terms and Conditions of Sale.
- “Contract” refers to the agreement for the sale of products between the Company and the Customer.
- “Goods” refers to the items (including parts thereof) which the Company agrees to supply in accordance with these Conditions.
- “Working Days” refers to any day that is not a Saturday, Sunday, or public holiday.
- “Carrier” refers to any individual or company responsible for delivering the Goods to the Customer.
- “Writing” includes communication by letter, fax, email, text, or any similar form.
- “Bespoke” refers to items custom-made to the Customer’s specifications.
Headings in these Conditions are for convenience and do not affect interpretation.
1. General Terms and Conditions
1.1 These Terms and Conditions outline your rights and obligations in relation to our website and purchases made through it. Please read them carefully.
1.2 Your statutory rights as a consumer under the Unfair Contract Terms Act 1977 are not affected by these Conditions.
1.3 Consumer rights under the Consumer Protection (Distance Selling) Regulations 2000, where applicable, are not affected by these Conditions.
1.4 By accessing our website and placing an order, you agree to be legally bound by these Terms and Conditions. All Goods are subject to availability.

1.6 These Conditions constitute the entire agreement for sales, and no variation or alteration is permitted unless approved in writing by the Company.
1.7 These Conditions apply to all contracts and take precedence over any other terms unless otherwise stated by law.
1.8 Acceptance of Goods by the Customer confirms that these Conditions apply.
1.9 AJS Sawmill Ltd reserves the right to modify these Conditions without prior notice. Updated versions will be posted on the website, and we advise customers to review them before ordering.
2. Purchasing from Us
2.1 Full payment is required at the time of ordering. Payments may be made by debit or credit card, bank transfer, or PayPal.
2.2 PayPal’s full terms and conditions can be found at: PayPal User Agreement.
2.4 By submitting your order, you offer to purchase the Goods at the agreed price and consent to us using your personal details for order fulfillment, including passing your details to couriers.
2.5 It is the Customer’s responsibility to ensure that all details provided are accurate and that the delivered Goods meet these requirements.
2.6 Products marked “Made-to-Measure” or “Bespoke” are custom-made and cannot be restocked or returned once ordered.
2.7 The Company accepts no responsibility for products ordered incorrectly by the Customer and cannot accept returns on bespoke items.
2.8 Upon receipt of a bespoke order, an order confirmation will be sent, which should be checked carefully for accuracy. Changes may be made only if the order has not yet entered production, and charges may apply if changes are requested after production begins.
2.9 Quotes based on drawings must be confirmed by both the Customer and the manufacturing manager. A size variance of up to 10mm may occur. By completing the purchase, the Customer confirms the accuracy of the drawings.
2.10 Bespoke items may include instructions that differ from standard products. The Company is not liable for any damages caused by incorrect installation or sizing.
2.11 An email address is required for all orders. A confirmation email will be sent acknowledging receipt of your order. This email does not constitute a contract.
2.12 For manufactured orders, the “first working day” of your order is the day we receive confirmation of your order, not the day it was placed.
2.13 If an ordered product becomes out of stock, we will provide an estimated restocking date. You may choose to wait or receive a full refund.
2.14 Delivery address changes are not permitted after the order is placed. If a change is required, the order may be canceled and refunded, and a new order must be placed.
2.15 AJS Sawmill products are intended for outdoor use unless specified otherwise. We are not liable for products used for unintended purposes.
3. Pricing
3.1 Prices on our website are in pounds sterling and include VAT.
3.2 The Company reserves the right to adjust prices before an order is placed.
3.3 No additional charge is applied for debit or credit card payments.
3.4 Full payment for Goods, including carriage charges where applicable, is required before the order is accepted.
3.5 Quotations are not offers and may be withdrawn or revised at any time before an order is accepted.
4. Quality
4.1 Timber is a natural product and may react to environmental conditions. The Company does not guarantee against warping, twisting, or splitting due to weather.
4.2 Timber products must be treated upon delivery and regularly maintained. The Company is not liable for wood rot, mould, or defects caused by neglect.
4.3 Products should be re-treated regularly for longevity. Failure to maintain products voids any liability for defects.
4.4 The Company will not cover consequential costs related to product replacement.
4.5 The Company is not liable for defects caused by insufficient or inappropriate hardware.
4.6 The Company is not responsible for natural defects such as warping, colour variations, or timber size fluctuations.
5. Damages
5.1 Goods must be inspected upon delivery. Any damage must be reported within 2 working days.
5.2 Photographic evidence of damages should be emailed to info@ajssawmill.co.uk.
5.3 The Company will replace or refund damaged products, but is not liable for consequential losses.
5.4 Ownership of the Goods transfers upon delivery, and the Company is not responsible for any loss or damage thereafter.
5.5 The Company is not obligated to repair, replace, or refund any product that has been installed before reporting any damage.
6. Installation
6.1 The Company supplies products only and is not responsible for installation costs or damages caused during installation.
6.2 The Company is not liable for damages or injuries caused by improper installation by third parties.
7. Delivery
7.1 Free delivery is available to most of the UK mainland for orders over a minimum amount (inclusive of VAT). Additional charges apply for excluded areas.
7.2 It is the Customer’s responsibility to provide an accurate delivery address. Re-delivery charges may apply for incorrect addresses.
7.3 The Company is not responsible for goods left in a safe location at the Customer’s request.
7.4 The Company is not responsible for courier delays once the goods have been dispatched.
7.5 The Company is not liable for damages caused by third-party couriers.
7.6 Bespoke items cannot be returned under the Distance Selling Regulations unless they are damaged or do not meet the agreed specifications.
7.7 Timber may arrive wet due to outdoor storage or transport conditions. The Company is not liable for timber arriving in a wet condition.

8. Cancellation, Returns & Refunds
8.1 Standard items may be canceled within 14 days of delivery, under the Distance Selling Regulations, except for business-to-business transactions.
8.2 Bespoke orders cannot be canceled once production begins.
8.3 Upon agreed cancellation, refunds will be processed within 30 days.
8.4 Installed, modified, painted, or stained Goods cannot be returned.
8.5 If a return is requested, the Company reserves the right to charge a collection and handling fee.
8.6 Goods must be returned in re-sellable condition. A return number must be obtained before returning Goods.
8.7 The Customer is responsible for any courier costs and obtaining proof of delivery for returns.
8.8 If returned Goods are not in re-sellable condition, the Company may charge a fee.
8.9 For bespoke items, the Company may charge up to 50% of the order price for cancellations.
9. Cancellation by Us
9.1 The Company may cancel an order if:
- There is insufficient stock.
- Delivery is not available in your area.
- Goods were listed at an incorrect price due to error.
9.2 If an order is canceled, the Company will notify you by email and issue a full refund within 30 days.
10. Liability
10.1 The Company will repair, replace, or refund defective goods if:
- Written notice of the defect is provided within seven days of delivery.
- The Customer does not use the goods further after notifying the Company of the defect.
- The defect was not caused by negligence, incorrect use, or improper maintenance.
10.2 The Company’s liability is limited to the contract price and excludes consequential losses.
10.3 The Company will provide information on manufacturer warranties but is not responsible for obligations under these warranties.
10.4 Implied warranties are excluded to the fullest extent permitted by law.
10.5 The Company is not liable for indirect losses, including loss of profit or business.
10.6 The Company’s liability is not limited for death, personal injury, or fraud caused by negligence.

All notices to the Company must be sent in writing to AJS Sawmill Ltd, 1 Wood Cottages, Sealand, Chester CH1 6BX.
